Fox Wood Modifications Committee Meeting
Minutes of our February 3, 2005

The Modifications Committee met at 6:30 pm at Trinity Outpatient Center on February 3, 2005, and those in attendance were as follows: Tim Gibson, Mandy Gibson, Helen Yauger, Mike Yauger, Bob Niemiec, Diane Kocienda, Wendy Dong, Alan Allred, and Jesse Erickson. There were five residents in attendance.

Wendy was congratulated for being appointed to the Fox Wood Homeowners Association Board. A welcome was given to two new members of the Modifications Committee, Alan Allred and Jesse Erickson.

The architectural standards approved by The Modifications Committee and recently presented to the Fox Wood Homeowners Association, were approved with one change in storm shutters, please note below. These will be presented to Adam Smith Enterprises for approval.

Storm Shutters: The job of any storm shutter is to protect your glass areas from breakage when hit by flying debris. There are many styles and types of both permanent and temporary shutters.
Screening (front porch, doors, garage): Screening of front porch areas is not allowed within the community in order to maintain the architectural integrity and a uniform appearance of Fox Wood. Screen doors on entryways and on garages must have prior Modifications Committee approval. Submit plans, sketch, or drawing with applications. Front doors that are screened should be in colors that are acceptable and should be compatible with the door and door jam assembly.
Satellite Dishes [10.03.12 and amendment dated 7/18/97 replacing 10.03.12] Property owners are permitted to install satellite dishes or antennas on a permanent basis provided the satellite dish or antenna complies with the Telecommunications Act of 1996, part II of Title III, Section 207. The following shall also apply:
Our file storage problem has been resolved for now. They will be kept in my home, because we need to use them frequently. When we finish organizing and get caught up, this will be rethought.
Recent actions that our committee members need to be aware of were discussed. Some deed restrictions violations were observed by our committee members, and these were turned over to Deed Restrictions Enforcement. Below is the list:
A tiki hut was also observed. The files were checked to see if there was an approval or an application on file. Neither was found in the file or on our logs. Since outside structures are not allowed a letter was written for it to be removed. An unpainted wooden fence was noted. The resident received a letter concerning his unpainted fence. The resident wants to oak stain the fence, and since this is not an option according the architectural standards that have already been approved, the resident has made an appeal, which is still pending.
Wendy brought up a problem with the statement used in the letters that go to the residents, concerning fences being 6" inside the property line. There was a discussion concerning this and it does make it hard to tie into a neighbor's fence if the fences are too far apart. The new statement will say inside the property line.
At last months meeting the committee was asked to go through their deed restrictions book to make sure that there were no other architectural standards that needed defining. Only two were brought up at our meeting and they are golf carts and gutters.

There was a discussion concerning the colors that can be used to paint homes in Fox Wood. Mandy went to the following paint companies and was given their color palettes: Lowes, Wal-Mart, Home Depot, Scotts, Glidden, Sherwin Williams, Color Wheel, Behr, and Benjamin Moore. Mandy was asked to head the committee to choose the acceptable colors. Three people on our committee volunteered to help; they are Bob Niemiec, Diane Kocienda, and Wendy Dong. Tim will contact Don Latimer and ask for volunteers from Deed Restrictions. It was also noted that Dave Renwick suggested that we stick with the colors originally chosen for Fox Wood which are earth tones.
The meeting was opened for questions from the residents. It was asked how we go about making decisions. We explained that this is not a one person committee and that is why each alteration application that is handled is first done by one committee member, who actually visits the resident to answer any questions they may have, and then that committee member presents it to the full committee for final approval. Another area that an explanation was requested was concerning the surveys that we do. Each committee member has a territory that they cover. Members can walk or drive through their area. We have a data base which shows what things each resident has sent to us on an alteration application, and there is a copy of the letter sent to the resident giving them approval or denial for their request. When we go through our territory it is easy to check our data base to see if something seen has an approval on file. If there is not approval we note the data base for later action. We do not go on property unless the resident has given us permission and the resident is present. Our goal is to get all the resident's files updated as to what changes they have made to the exterior of their property. Someone else wasn't aware that gazebos were not allowed and it was explained you are not allowed to put a separate structure in your back yard.
